Again, this is an interesting twist, but I have no idea how the evidence would be any different if someone intentionally threw it. Say Fuyuhiko and Nagito struck up some sort of deal. Fuyuhiko keeps the poison grenade on his person and just doesnt grab one when we go to the break room. He tosses the grenade when everyone else does. How can we rule that out? How would anything be different?
Our scenario is pretty bad though since now we have no clue who did it.
Oh Monokuma straight up admits that the murderer is whoever made Nagito breath in the poison. So that resolves that uncertainty I suppose.
Also this is BOLGNA. This is still a suicide. There isnt a court in the world that would convict whoever the guilty party is. Nagito is the one who made Nagito breath the poison. He set up a scenario where hed be forced to drink the poison and did everything other than throw the bottle (which the person thought was a bottle of something else). That isnt murder. I really wish there was a scene where Nagito set this all up, laid down, pulled up his spear and then realized his measurement was off by like half a foot so it was dangling a little over to his left. Ok so Nagito has ultimate luck right? Heres what he does. Get a piece of paper. Write the traitor is at the top and then assign the six survivors a number. Get a dice. Roll the dice. Chiaki basically goads Hajime into picking her as the traitor, and when you do she fesses up immediately. I have so many questions but for now Im going to keep reading because I need to know more.
Shes also not a very good traitor because she basically was the one that was most responsible for figuring out this case, and then the only one pushing the murderer mustve been the traitor narrative.

There is a dramatic scene where Chiaki begs with Hajiime to reveal her as the traitor and Hajime begs with her to not make him do that because its the same as killing her. THE EMOTIONS. THE EMOTIOOOOOONS.
