State police Col. James Manni said Thursday that the investigation determined it had not. This conclusion was based on analysis of video, the lack of damage to the rear of the moped, and a review of the damage to the front of the cruiser. The cruiser did crash into a stop sign, which Manni said fell on top of Gonsalves' head after his vehicle had crashed into the wall. But investigators determined that Endres was trying to avoid a crash, not cause one.

However, investigators determined that the cruiser entered the intersection before Endres asked officers to "box" Gonsalves in, and not in response to that request, and that it had cleared the southbound lanes of Elmwood Avenue before Gonsalves attempted to make a turn onto Bissell Street.
Neronha said his office considered charging Endres with driving to endanger, but in order to try such a case, he would have to prove that the officer had driven recklessly, not just negligently. The office concluded that there was not proof of reckless driving. He said it was possible that negligence was involved.
