Standing in a fighting pose does not equal actual physical violence. So since it was all 1 sided...and again technically the white guy standing back up and coming after him after he was assaulted with a weapon he's now defending himself. I'm going to have to assume the black guy gets charged with assault. Would a can of Iced Tea count as a deadly weapon too?
