In theory any establishment could use that to argue the government has no right to stop them from opening. There's no need for religion to be a factor at all. The counter argument to that IMO is that in a pandemic, being near large groups of other people is not peaceful. It is literally inflicting harm on others by the mere presence of one infected person.
