Until the gunman brandishes his weapon you cant just pull a gun on him preemptively, and after hes done so hes already got the drop on you. The only problem is he did this a few days after that Wal-Mart mass shooting so people panicked and some guy with a concealed gun pulled it on him and held him at gun point until the cops came to arrest him. They charged him with making a terrorist threat and last month he plead guilty to some lesser crime.
