Yes, I would imagine so. Some places will just take the fine, if they are in the middle of nowhere.

Don't know, that should be easy to look up. But then you get into states rights.
Gotta imagine the tobacco states would fight hard against that.

They have their ways to pressure property owners.

Having said that, I live in NY where you are not supposed to smoke within, 15 feet of a building, and it happens all the time. But the law is seldom enforced.
