But you're not sticking within the confines of the scenario that is being referenced. The character is not a known rapist. Your scenario uses someone who is an actual threat by their very nature of being a "mobster". Regardless, if you hand over your stuff without being told that you need to hand over your stuff then that's on you. They didn't steal your property if you just up and volunteer it without any actual coercion or at the very least without them asking for it.
