" Bethesda also took issue with Hupps use of the word new in selling the unwrapped game, claiming that this constituted false advertising. I mean if it was factory sealed then yes this is a new copy. Technically though being as the guy bought it and wants to resell it it's been through another pair of hands thus second hand despite being factory sealed. Although as far as I'm concerned if it's factory sealed it's new and games get passed through many hands before they get to you anyway.
