Huh, as dumb as this sounds, this actually makes sense to me. Mostly because it's just talking about business action and not any of this garbage.

You could argue that prostitutes create art, and you can't economically force an artist to create something that they don't want to create. With all of the personal creativity related stuff.
Buuut, you can't claim it's a painting, or video, or sculpture, or anything else similar to that. It's not under any of traditional legal definition of art, from my quick googling and skimming of a pdf.
I don't think that would hold water.

Hilariously, you could claim it as "fine art" under The New York Act, as you can't have more than 500 copies of it, but you still have to define it as art, so we're back to the "it's not art" problem.

You could, theoretically, also trademark a sex move/position. You have originality (including substantial originality), figuring out how to separate different trademarks would be difficult, but not impossible as well. The usefulness clause can basically be ignored, because hue hue sex.
