Overstaying a visa is only punishable by deportation. No federal statute defines it as a crime. What is different and wrong (and in violation of human rights) at this time are that children are now separated from the families. It used to be that everyone was sent back together. Now children are taken and held after parents are deported. Asylum claims are done legally at ports of entry. This is, for the most part, illegal crossings. So they are being prosecuted for it. As they should be. These applications can be done by people that do not have permission to enter. Now when people try to enter to claim asylum the family is separated and the parent is deported--without children--without being given a chance to apply. This is not what was done before.
