From Wikipedia "As of August 2008, 46 states in the United States have a felony murder rule, under which felony murder is generally first-degree murder." Melon_Master posted... Isn't it transferred intent or does that follow under felony murder? (I could be confused lol) Again from Wikipedia "Critics of the felony murder rule argue that the rule is unjust because it requires no intent to kill." As to how it applies here - "In most jurisdictions, to qualify as an underlying offense for a felony murder charge, the underlying offense must present a foreseeable danger to life, and the link between the offense and the death must not be too remote." I think the foreseeable danger to life is rather obvious. Whether the link is remote or not hinges on the cop who did the actual shooting and how they are trained to handle hostage situations given the information provided by the supposed perpetrator. --- No locked doors, no windows barred.
