People always act like intent is an unprovable thing. It's proven in courts of law every single day. You can gague someone's intent by surrounding factors. In the Laugh Factory incident, the greatest piece of evidence that it was a joke is the fact that he said it in the middle of a stand up routine - the context for where such a joke would be made. Second, comedians usually insult hecklers to get laughs. Third, he has no prior public history of racism. Fourth, close friends vouched for him instead of distancing themselves. Fifth, he apologized right after (unlike Jontron).

Intent is not as clear cut as we want it to be, but it's what separates something meant to be taken seriously (not a joke) from something that is not meant to be taken seriously (a joke).
