You are making a baseless claim that this is an unenforceable term, and as evidence you state that they cannot claim ownership over your house and car, something totally unrelated to the air travel agreement being entered into. It is illegal to sell someone a service and then not provide that service. Putting "we may choose to just not give you this service at any time" after selling you the service is illegal.
