An airline should never actually exercise this option because it's a PR disaster, but they absolutely can.


ToS aren't legally binding. You can't put shit in fine print that says "by buying this plane ticket, we own your house and car."

Like, that works on fairies and contracts with Satan, but in real life any Judge with half a brain will rule the contact is bullshit.


Most contracts aren't actually legally binding. At the most the just sort of make it a bit more difficult to sue the company. But, in this case though. The Airline is not only clearly in the wrong, but so if the CEO. So, if anything. They will likely either settle and throw the Air Martial under the bus or the company that trained him.
