Just saw that. Opting out only refers to future clauses. Not sure why more people aren't upset. When Sony and EA rolled out similar clauses which you could opt out of, people were (justifiably) upset.
Because Sony has screwed up before, and EA is the devil
Microsoft isn't really in either of those boats.
