Yes, it is. Like I said, "bad" is subjective. Let's say that I nominate a bunch of rap-related AoDs and Zach throws them all out because he thinks any AoD about rap music is bad. That's not being neutral.
Otherwise I agree with you for the most part. Something should be done (which is why I said I'm for making the denomination system more effective or limiting the amount of nominations a user can make). I think that if the denom system is more effective and people keep denomming LMS' nominations, he'll stop nominating stuff eventually. If he doesn't and keeps being a nuisance, that would be the point to do something as drastic as banning him, I guess.
