I disagree that they have a EULA like this just to protect themselves against frivolous lawsuits. This EULA protects Sony from non-frivolous class action lawsuits as well. I don't see why they would give up this protection even if frivolous lawsuits magically stopped happening. The other possibility is EULAs like this wouldn't be allowed in a world without frivolous lawsuits but I have no idea if that would be true or not.

What if with a PS4 (just an example), they have all these cool features on the box, all of these advertisements, etc, that don't mention anything like having to sign a Terms of Service, about having to always be connected to their server to play even single player games?

I mean it's entirely possible with how gaming is going, and logical to assume, that everything will be online. So you get the PS4 only to later find out that you either have to digitally sign some agreement (and by sign I mean check a box considering you never actually sign anything, even now) or not use your system.

Aren't there PC games with DRM like that? I'm not sure if they normally explain the DRM on the box, though. In the PS4 example you could return it if you don't like the conditions in the ToS.


There probably are. As far as I know, with most stores that sell new systems, you cannot return them. Target and Walmart might have different policies, but the general rule is that once opened, it can't be returned.
