what happened last time? cease and desist?
If I remember correctly, it was something far more ridiculous. The creator dude realized he didn't actually want to put all the work necessary into completing the project, but he'd been taking donations. So he faked his own death.
As far as I know, Nintendo doesn't really send out cease & desist orders for little fan projects.
