The requirement was unreasonable to the point that it functionally prohibited him from doing it but the HOA was still within their rights to do so. Does this change help him at all? Yes, the HOA is pulling those provisions straight from Texas HB362. However, send him info about Texas Property Code Title 11 Chapter 202 Sec. 202.010. This is a separate state law that says HOAs can't prevent people from installing solar energy devices. That's the same fight I went through.
