Yes, the HOA is pulling those provisions straight from Texas HB362. However, send him info about Texas Property Code Title 11 Chapter 202 Sec. 202.010. This is a separate state law that says HOAs can't prevent people from installing solar energy devices. That's the same fight I went through. I'm now just waiting on Tesla to get through some supply chain issues before installation.
