The dude doesn't know what he means when he throws around "public service" with his legal threat or is trying to talk fast and twist the common phrase "Open [for business] to the public". The real context to the law he's trying to recite refers to services provided by the government that are considered federally protected. Example of this would be protection against denial of enrollment into a public school. In no way does it compel a private entity (in this case cookie shop) to provide a service and they can ask you to leave their private business at their discretion and without providing a reason beyond "because I said so".

If it wasn't for the fact they seem lacking in intelligence I'd think they were trying to use the anti-discrimination laws like the gay wedding cake stories that pop up from time to time. They would be wrong, since any business can set a dress code, but I think it would be giving them too much credit to think they had any coherent thought beyond "I definitely know what was intended by the constitution and founding fathers and the police will surely agree with me" these people are so used to being on the side of police when they do awful things they think police will be on their side when they do awful things.
