Calories in has to always equal calories out, but the key point is that the "calories out" side of the equation is not static (or predictable) and people make the mistake of assuming that it is.
I hear you, but the statement Calories in = calories out is always going to be true is a fallacy that's used to attack obese people, some of whom have much healthier diets than their more svelt counterparts. I'm not saying that that was your intention obviously, I just don't want people to get confused by a concept that's been used to attack a specific group
