I mean, obviously it should be criminal, I just don't know if it needs a special designation vs. just being "distracted driving."
Don't let the racy aspect obscure that this is still no more distracting than someone talking on the phone while holding it (vs. blue tooth, speaker, etc...), applying makeup, or any of the other absolute stupid shit people do while driving.

She absolutely should be charged. Guarantee if it was a woman driving while a guy pleasured her, both would be charged.
And she absolutely noticed it was moving, especially considering he crashed into something before plowing into the victim. She's just lying b/c she'd rather look like an idiot than a criminal.
