For that matter just general common sense: someone has a weapon pointed at you and you don't want to get shot, don't do anything that could be misinterpreted. Right, wrong, fair or unfair doesn't matter at that moment. If you want to increase your chances of surviving a cop encounter, don't give them a reason.
