Him being at fault whether or not she should have disclosed absolutely does not track, just logically. If you believe that she had a responsibility to disclose it then he is not at fault for backing out because it wasn't actually what he agreed to and that was her fault for not disclosing. I'm not even talking about you disagreeing with me, your argument literally does not work logically.
