Generally, throwing something away terminates possession. That's literally one of the paradigm examples we used in property class in law school. You can't steal someone's trash. It's no longer theirs.

Even then, it's scummy, anti-human behavior to attack someone for attempting not to starve by eating discarded food. We've seen throughout the pandemic that cops have the discretion to just decide not to enforce mask mandates, social distancing etc. They are choosing to enforce an anti-human law.
