Remember that this all started because a poster said that all crimes like this should lead to the death penalty. Intent may soften the consequences compared to other crimes of its nature but the end result would still make it worse than if the result wasn't as bad. Plus in this specific instance the killer was committing a hate crime with the intent to cause serious injury with a clear disregard to the man's life and did eventually kill him.
