If it works via software emulation they need to get permission from game rights holders to add it to their online store and/or make the disc work. For a number of PS1 and 2 games this isn't possible as they are stuck in legal hell. There is a reason many PS1 and 2 games never got released on game archives, yet a launch PS3 can play all of them. The hardware emulation allowed them a legal work around.
