Conditional consent is real, and violating that is absolutely rape. If the condition was that he wear a condom, and he didn't then that is rape. If a woman lies about being on birth control, or a guy lies about having influence that he could use to help their career, that's rape too.

A Lie by omission is also a violation of conditional consent if the conditions are understood by both parties. If you have a transmittable STD and don't tell your partner, but you have reason to believe they don't already have it, failing to disclose that is just as bad as saying you don't have it and it being a lie.

And yes, if a man is conditionally having sex with a woman that he believes is a cis woman, and she's actually a trans woman and does not disclose it, that is rape too. There is nothing different about that scenario and the scenarios outlined above. You could argue it does no harm, but neither does saying you were a movie producer. It is a willing, fundamental violation of the conditions that the man consented to.
