That's only an issue on Xbox One due to the way Xbox One handles backwards compatible. It's not really just running the 360 game, it's loading an Xbox One compatible version of the 360 game. A different executable technically IIRC and you have to download the software from the Xbox store. That's why it needs to be licensed again.

If you make hardware that natively plays PS3 discs they don't need to get permission from the people who published the games. That's how GBA games work on DS, how GB games work on GBC, how PS1/PS2 on PS3 and so on.


In the case of NCAA it's legal. EA was sued by the NCAA and lost.

Has nothing to do with that. If it is hardware that naturally plays PS2/PS3 discs it can. There is no legal requirement to get permission to make these games playable.

Unless you are saying physical NCAA games on PS3 don't load anymore too.
