1. There doesn't have to be force for sex to qualify as rape. Only the absence of consent.
2. The nurse who processed her noted "penetrative trauma." That's medical speak for "something was shoved into her vagina hard enough to make it bleed." That sounds pretty forceful to me.

No. For this to not be a case of rape, she would have had to not send a clear signal meaning "yes." Consent is saying "yes," not just not saying "no."

Again, BAC doesn't affect everyone equally, as becomes immediately obvious if you ever drink with other people. Alcohol tolerance depends on a whole lot more than just blood volume.
