If the lawyers contesting his power grab are any smart they will contest it on the grounds that an EO can't override the constitution, without going into whether the amendment was interpreted correctly or not If I had to guess, I would say he never intended for this to actually stick and become implemented before a judicial injunction is slapped on it.
