The tactics being employed by Trump are underhanded and attempting to use a loophole of sorts, if you can call executive orders a loophole. Similar to unconstitutional gun laws that states knew would get challenged in court, that's what Trump's intent likely is with birthright citizenship. Get it to a high court and perhaps it could be interpreted to be in line with the constitution. Sadly our legislature doesn't do its job and law is more or less dictated from the bench now.


If the lawyers contesting his power grab are any smart they will contest it on the grounds that an EO can't override the constitution, without going into whether the amendment was interpreted correctly or not

If I had to guess, I would say he never intended for this to actually stick and become implemented before a judicial injunction is slapped on it. Its likely a stunt to rally his base.
