You'll still lose in court. Not that I see anyone doing such a thing over a few hundred dollars unless they can also be sure they'll win in getting you stuck paying all the court fees for them as well.

Of course, if they went that route then they can also destroy your reputation following the case by having a news segment about you being a scammer.
