The NFL blacklisted him to a point (he's still had interviews and tryouts since his last snap - you can say they didn't mean shit but they still happened), yes, but to legally prove that owners colluded against him in a joint decision not to hire him is a different ball game. As far as blacklisting goes, many, many able-bodied players have been blacklisted from the league. If Kaepernick wins his case, he'll get a lot of money. If he doesn't, he'll still get years of publicity from doing as much. Without the case being an ongoing entity, he really wouldn't justify continued media coverage beyond occasional pieces. So it doesn't really matter to him what happens.
