Black Panther has never beaten Silver Surfer for one. For two, you're using outliers to try to discount things that happen all the time.

Batman loses to those people I named constantly. It's his established level of ability.

And Spider-Man is a genius too but he has minor pre-cog, is super fast, and super strong compared to Batman. Batman for instance, gets regularly stomped by Deathstroke. A trained mercenary with minor super powers.

Spider-Man stomps someone similar in Wolverine.

1. Ah that's interesting. People always made it sound like it was a regular comic when they discussed it.
2. When Black Panther put the Silver Surfer in an armlock and he couldn't do anything to free himself I'm calling that a win. These situations where a person beats someone they have no business competing happen all of the time in comics. It is very common. You'll often see a strong fighter just straight job to another person just to prove how tough the new threat or protagonist is. That's just the way things work. You're also looking at multiple writers and each writer has a different interpretation/direction they want to take with the character.
3.Batman has also beaten white martians before though and is often written as someone that can exploit weaknesses and win against extremely tough opponents. I don't think this is a good argument.
4.Eh I'd argue that based off of what they can do Batman can situationally be tougher. Not that this matters. Spider-Man should beat both (especially Wolverine) in a random encounter.
