Yes, as in they are currently, successfully making the argument, and this argument is why they receive a not guilty verdict?


Yes, there's plenty of cases like this every year. They usually involve an unconscious woman at a party and as she was unconscious or intoxicated she could not consent. But the plaintiff, usually a man, says that she had consented and he wasn't aware of her condition. And more than a few of those cases result in a not guilty verdict because of reasonable doubt and the jury ultimately believing that maybe she had consented while intoxicated and that he didn't know she was passed out.

If you want a name of one such person who has gotten away with that defense, Reid Andrew Dawson from a few years ago.
