It took long enough for western nations to say " hey, just because these two people are married doesn't mean that they automatically consent to sex with their spouse 100% of the time" Yes, there's plenty of cases like this every year. They usually involve an unconscious woman at a party and as she was unconscious or intoxicated she could not consent. But the plaintiff, usually a man, says that she had consented and he wasn't aware of her condition. And more than a few of those cases result in a not guilty verdict because of reasonable doubt and the jury ultimately believing that maybe she had consented while intoxicated and that he didn't know she was passed out.
