Not necessarily. If nobody is home for instance, they can get the landlord or just break in. If the officer believes the person could try and escape or destroy evidence, they don't have to announce they're there, even. Same thing with if they believe somebody is being harmed inside. Look up no-knock warrants.

As long as they show it to you before returning the warrant to the judge that issued it (or a sufficient ranking officer of the court depending on the time of day and availability), it's pretty much just TV and a myth that they have to give you it beforehand.


Good post. Cant be fucked to listen to 6 mins of Dawkins but yeah cops can enter your house without a warrant under a few reasons (also varies on state).

Under the Good Faith clause cops can enter if they feel evidence is being destroyed (even a toilet flushing...) or if someone wont answer the door for obvious reasons, like in a domestic violence call.

Edit: skipped to the last 30 ish seconds of the video. I liked how Dawkins threatened to hit the cop (while recording the interaction no less) and get his ass floored
