The way the already existing law is written is that if you want hold the parents in custody while you investigate their case then you cannot keep them together with their kids. You would have to release them into the U.S. and hope that they actually return for their hearing when they're supposed to and don't just flee to a sanctuary city. You are correct. Maybe they could have included the not separating families part in the memo so that itd be how it is now. We have to secure our border, but we dont need to separate already desperate families.
