the process for US asylum literally begins at the border. if they approached an embassy or otherwise requested legal entry into the country beforehand, they would be handled under the refugee process which is differentin other words, the only way to initiate the asylum process is to waltz up to the border and ask for asylum. under current policy you're then held in custody until a decision is reached


That isn't what this lady did though...

Theyd had a plan: Elsa Johana Ortiz Enriquez packed up what little she had in Guatemala and traveled across Mexico with her 8-year-old son, Anthony. In a group, they rafted across the Rio Grande into Texas. From there they intended to join her boyfriend, Edgar, who had found a construction job in the United States.

She rafted across the Rio Grande and made a run for her boyfriend. :v The lady had to know what she was doing was wrong.
