I'm literally writing a casenote about that in law school right now. It's slowly shifting more towards sexual orientation being a protected class but in federal courts, it's still split fairly down the middle on whether it is or not. The 2nd circuit changed the law just a couple months ago and made sexual orientation a protected class and for the most part, I think the other circuits that haven't yet eventually will. --- Others find humanity by looking in their own hearts.
