With the only context we have, the individual (in the tux) was in the wrong and did the wrong thing. His hands are above his head at the start, he had control until he slammed his head into the glass.. watch it.. His hands were above his head because the officer had to get him to that point. It's clear the officer was struggling to control him from the start of the video. Also, his head wasn't "slammed" against the glass. edit: And actually, only one of his hands were in the air.
