I already love Game of Thrones, and to have a similar drama set in the LOTR fantasy world has me super excited.

But doesn't the Tolkien family still own the rights for The Silmarillion? How will that work?

While you can kinda make some comparisons between LOTR and Game of Thrones with the struggles and fights between the Sons of Feanor and the rest of the elven families and some other things, I'd rather not have gratuitous scenes where Sauron or Fingolfin is banging some elf whore.
