Yeah, but some providers choose to oversell their network capacity and slow users down in times of high usage (throttle) and others choose to make sure their network can handle the bandwidth they're selling to customers.

And let's not forget that Comcast was known to throttle services prior to the 2015 net neutrality regulations.

The netflix thing was another grey area of sorts, but I won't argue your first statement. Though I would question WHAT broadband providers do NOT oversell their capacity...
