I've been to all kinds of In N Out in SoCal and never had this experience ever. My food has been cold 100% of the times I've been there. If they serve you cold food, then they totally destroyed their motto in serving fresh food to you. If you complain about it, I can guarantee that they will bring out a new batch that is hot and fresh.
