If he gets a DNA test proving the child is not his before the divorce and challenges, contests, or rebuts paternity with the evidence which proves he is not the father the state can not force him to pay child support.

He's already acted in the role of father to this child. If this were within a few months of the child's birth, mayyybe he'd have a case. That's not even getting into the fact that a child born to a married woman is automatically, legally presumed to be her husband's. If they ever divorce, he WILL be on the hook for child support.

Seriously, in 99% of cases, a judge will laugh you out of the room for trying to bring up DNA evidence.

Also, fun fact: in some states, a child born within 300 days of a finalized divorce? Still legally considered the husband's. Now, he certainly has options to remove himself from the legal entanglement, but can you imagine that? Your wife cheats and gets knocked up. Even if you file immediately, it may not be processed "in time."
