I mean, despite the fact that it's weird for the government to technically be playing both sides, it's not that surprising. Sexual orientation is not a protected class in the 14th amendment and there has been no federal act to make sexual discrimination illegal in state workplaces, so it's de-facto legal and it's been up to the states to protect gay people, which many haven't done. So the DOJ argument is actually based on precedent (which has been not to protect LGBT individuals), while the opposition is in the weaker position of trying to change the law. Luckily, the Obergefell marriage decision moved gay people up in the world, so we have more of a chance than we did before then.

With any hope, S.C. will read sexual discrimination into the 14th amendment and stop all this bullshit from happening.
