Say a dirty back check knocks a guy into the boards and he ends up paralyzed, or a batter gets smoked in the head with a fastball causing a significant loss in brain function or something awful like that. Would the victim be able to sue the checker?
If someone is blatantly performing an action in a sport that runs afoul of that sport's rules and regulations because that action is inherently dangerous and harmful to the life and health of an individual playing that sport, then they should be charged for whatever harm results from their recklessness. Someone getting checked into the boards wouldn't fall into that, since checking is a normal part of the game and isn't in and of itself a rules violation. Kicking someone with your skates is though.
