It's a tough spot. The "proper" thing to do, in my eyes, is just for them to buy a new house somewhere else. Especially after 3 years that this has been dragging on. I don't think they did anything wrong but the optics of this aren't great.

I wouldn't expect them to know the dude just had surgery and wasn't all there. Someone in his family should have been looking out for him if he was that unwell. How did the contract even get in front of him?

This is just going to drag on in the courts causing that dude to get mental evaluations to judge his competency. He will probably die before it's all over. They should just move on to end this.
