It shouldn't be, however he already did it to Andrew Warren, who filed a suit saying he was suspended because of his free speech, and the FLSC dismissed it claiming he waited too long to bring that case.

So he's already gotten away with it once, hopefully she'll fare better, however Warren's case was more damning because all he did was sign some sort of pledge to not enforce abortion laws to draconian standards, whereas with Worrell presumably the state is going to use her prosecution stats against her.
I think he was found guilty of a 1st Amendment violation last time but the judge had no power to reinstate the previous AG
