The difference here becomes intent. This man intentionally chased his car to ram into them. He intentionally wanted to cause harm. Someone who blacks out or is hallucinating because of inebriation are at least not intentionally meaning to cause harm, their state of impairment just created the conditions for such.

To use a different example, there's a difference between pointing a gun at someone and pulling the trigger, and shooting up in the air with the bullet coming down and killing someone you don't even see.

In my own city, which is a border city, someone in Juarez fired a gun whose stray bullet struck someone in the leg of downtown El Paso. That person obviously wasn't trying to shoot them as cartel members who slaughter families intend.

For me the difference and what I'm hung up on is would he have done this or gotten as drunk if he were out in public? I feel like he was at home, in his safe space and (very very poorly) reacted to a situation he didn't create or ask for, a group antagonizing him.

Certainly the kids do deserve sympathy and we all did dumb shit like this, but times have radically changed and imo there should be an equal amount of energy dedicated to why prank culture needs to stop and our kids need to understand "stranger danger" goes faaaaaaaar beyond creepy dudes in vans these days. If you don't know someone, don't mess with them regardless of how harmless it may seem. 4 lives are now over because of a mooning gone horribly wrong.
