While even as a private business you can't discriminate based on race, religion or sexuality you are still absolutely allowed to discriminate based on content. If I wanted a penis cake for my gay wedding they would be well within their right to say no because I asked for a penis but they shouldn't be and are not allowed to say no because it is for a gay wedding.
